De bescherming van uw persoonsgegevens is zeer belangrijk voor HUGO BOSS. Derhalve zal HUGO BOSS uw persoonsgegevens uitsluitend verzamelen, verwerken en gebruiken in overeenstemming met het bepaalde in deze privacyverklaring en de van toepassing zijnde wetgeving inzake gegevensbescherming.

B. Uw persoonsgegevens

Het begrip “persoonsgegevens” omvat alle informatie waarmee de identiteit van een individu wordt of kan worden vastgesteld. Dergelijke gegevens zijn onder meer uw naam, uw telefoonnummer en uw (e-mail)adres.

C. Omvang van het verzamelen, verwerken en gebruik van de gegevens

Het is niet nodig persoonsgegevens te verstrekken indien u enkel de website of de Online Stores bezoekt.

I. HUGO BOSS

HUGO BOSS zal uw persoonsgegevens uitsluitend verzamelen, verwerken en gebruiken in verband met het aanmaken en exploiteren van uw klantenaccount en teneinde u de diensten te kunnen leveren die in dit verband worden aangeboden. Verder geldt dat HUGO BOSS zonder uw voorafgaande toestemming uw persoonsgegevens niet voor enig ander doeleinde zal verzamelen, verwerken of gebruiken.

II. HB IM

HB IM zal de persoonsgegevens die bij het opnemen van uw bestelling zijn verzameld verzamelen, verwerken en gebruiken teneinde deze bestelling te verwerken en uitvoering te geven aan de koopovereenkomsten die u met haar in de Online Store aangaat. Zonder uw voorafgaande toestemming zal HB IM uw persoonsgegevens niet voor enig ander doeleinde verzamelen, verwerken of gebruiken.

D. Uw klantenaccount van HUGO BOSS

Op de website kunt u voor de Online Store een persoonlijke klantenaccount (mijn account) aanmaken (hierna te noemen: de “klantenaccount”). U kunt uw persoonsgegevens in uw klantenaccount opslaan om hiermee uw winkelgemak in de Online Store te vergroten. Daarnaast biedt HUGO BOSS u voor uw gemak bepaalde opties waarmee u bijvoorbeeld uw bestelgeschiedenis kunt inzien en een persoonlijke verlanglijst kunt aanmaken waarin u later te bestellen artikelen kunt opnemen.

Uw klantenaccount wordt door HUGO BOSS geëxploiteerd. Om uw persoonlijke klantenaccount van HUGO BOSS aan te maken, dient u uw voor- en achternaam alsmede uw e-mailadres en een zelfgekozen wachtwoord te verstrekken. Het door u verstrekte e-mailadres dient tevens als uw gebruikersnaam voor de klantenaccount. Zodra uw registratie met succes is afgerond, ontvangt u automatisch een bevestiging per e-mail.

In het persoonlijke deel van uw klantenaccount kunt u te allen tijde uw persoonsgegevens bijwerken en indien gewenst aanvullende informatie invoeren (bijv. uw adres, telefoonnummer en geboortedatum).

E. Gebruik van de Online Store

De in de website geïntegreerde Online Store wordt door HB IM geëxploiteerd. HB IM is uw enige contractpartij bij aankopen die u in de Online Store doet.

Teneinde het winkelen in de Online Store zo gebruiksvriendelijk en eenvoudig mogelijk te maken, is de Online Store rechtstreeks aan de website gekoppeld. Met uw klantenaccount hebt u toegang tot de gegevens die u in het verleden hebt opgeslagen zonder dat u zich opnieuw moet laten registreren. Dit zorgt voor nog meer winkelgemak in de Online Store. HUGO BOSS maakt de voor het verwerken van uw bestelling benodigde informatie automatisch aan HB IM bekend, zulks in overeenstemming met de hierna volgende bepalingen:

I. Bestellingen die vanaf een klantenaccount van HUGO BOSS worden geplaatst

De in uw klantenaccount opgeslagen informatie wordt in het centrale klantenbestand van HUGO BOSS opgeslagen en wordt uitsluitend per geval aan HB IM verstrekt, zulks uitsluitend wanneer dit nodig is voor het verwerken van uw bestelling. Wanneer u een bestelling plaatst, wordt u verzocht bepaalde informatie in te voeren op het desbetreffende bestelformulier “1. Adressen & Verzending”. Wanneer de benodigde informatie in uw klantenaccount is opgeslagen, wordt dit automatisch in het bestelformulier ingevoerd. De gegevens worden pas aan HB IM overgedragen zodra u op de knop “doorgaan” op het bestelformulier “1. Adressen & Verzending” hebt geklikt.

HB IM zal uw gegevens uitsluitend gebruiken voor het verwerken van uw bestellingen en om uitvoering te geven aan de koopovereenkomsten die u met haar in de Online Store aangaat. Verder geldt dat HB IM zonder uw voorafgaande toestemming uw persoonsgegevens niet voor enig ander doeleinde zal verzamelen, verwerken of gebruiken.

II. Rechtstreekse bestellingen

Vanzelfsprekend kunt u tevens een bestelling in de Online Store plaatsen zonder een bestaande klantenaccount te gebruiken. In dat geval voert u simpelweg de voor het verwerken van uw bestelling benodigde informatie in op het bestelformulier “1. Adressen & Verzending” en klikt u vervolgens op de knop “doorgaan” teneinde de gegevens rechtstreeks aan HB IM te verzenden. HB IM zal uw gegevens uitsluitend gebruiken voor het verwerken van uw bestellingen en om uitvoering te geven aan de koopovereenkomsten die u met haar in de Online Store aangaat. Verder geldt dat HB IM uw persoonsgegevens zonder uw voorafgaande toestemming niet voor enig ander doeleinde zal verzamelen, verwerken of gebruiken.

III. Overdracht van bestelinformatie

Indien u bij het plaatsen van uw bestelling in de Online Store gebruik hebt gemaakt van een bestaande klantenaccount, hebt u door op de knop “doorgaan” op het bestelformulier “1. Adressen & Verzending” te klikken ermee ingestemd dat HB IM bepaalde informatie in verband met uw bestelling (het gekochte artikel, de prijs daarvan en het moment van aankoop) aan HUGO BOSS overdraagt opdat uw bestelgeschiedenis (die in uw klantenaccount kan worden geraadpleegd) kan worden bijgewerkt.

U kunt zonder opgaaf van redenen uw toestemming voor toekomstige bestellingen te allen tijde intrekken.

F. My Account

Op de website kunt u tevens een persoonlijke “my account” aanmaken, waarmee u van een breed scala aan diensten gebruik kunt maken en van talloze voordelen kunt profiteren, zoals uitnodigingen voor evenementen in de winkel of live-uitzendingen van modeshows. Uw persoonlijke “my account” wordt door HUGO BOSS geëxploiteerd.

De enige gegevens die u voor het aanmaken van uw eigen persoonlijke “mijn account” dient te verstrekken, zijn uw voor- en achternaam, adres, land, uw e-mailadres en een zelfgekozen wachtwoord. Het door u verstrekte e-mailadres dient tevens als uw gebruikersnaam wanneer u op uw “my account” inlogt. Zodra uw registratie met succes is afgerond, ontvangt u automatisch een bevestiging per e-mail.

In het persoonlijke deel van uw “my account” kunt u te allen tijde uw persoonsgegevens bijwerken.

G. Gebruik van logistieke dienstverleners en overige dienstverleners

HB IM stelt de persoonsgegevens die u bij het plaatsen van uw bestelling hebt verstrekt aan logistieke dienstverleners beschikbaar, in binnen- en buitenland. Deze dienstverleners nemen alle nodige veiligheidsmaatregelen wanneer zij deze gegevens namens HB IM verwerken, zulks in overeenstemming met het bepaalde in deze privacyverklaring.

HB IM of HUGO BOSS kan uw persoonsgegevens aan overige dienstverleners verstrekken, in binnen- en buitenland. Deze dienstverleners nemen alle nodige veiligheidsmaatregelen wanneer zij deze gegevens namens HB IM of HUGO BOSS verwerken, zulks in overeenstemming met het bepaalde in deze privacyverklaring.

H. Gebruik van de contactformulieren

U kunt rechtstreeks contact met ons opnemen door middel van de contactformulieren op de website en in de Online Store. HUGO BOSS en HB IM zullen de informatie die u op een contactformulier verstrekt uitsluitend verzamelen, verwerken en gebruiken teneinde de kwestie waarover u op dit formulier geschreven hebt, af te handelen.

I. Aanmelding nieuwsbrief/klantenonderzoek

HUGO BOSS verstuurt regelmatig nieuwsbrieven aan geïnteresseerden die zich hiervoor hebben aangemeld. Indien u zich voor een van de nieuwsbrieven van HUGO BOSS hebt aangemeld, zal HUGO BOSS uw persoonsgegevens uitsluitend verzamelen en verwerken voor zover dit noodzakelijk is om de betreffende nieuwsbrief aan u te verzenden. Indien u uw abonnement op een bepaalde nieuwsbrief opzegt, worden uw gegevens onmiddellijk verwijderd. U kunt uw abonnement te allen tijde opzeggen door op de betreffende webkoppeling in elke nieuwsbrief te.

Na uw aankoop in de Online Store biedt HB IM u de mogelijkheid aan een klanttevredenheidsonderzoek deel te nemen en uw winkelervaring te beoordelen. Indien u ermee instemt aan het klanttevredenheidsonderzoek deel te nemen, ontvangt u per e-mail een webkoppeling met een anoniem onderzoeksformulier.

J. Verzending van reclame/nieuwsbrieven

Teneinde reclame/nieuwsbrieven te kunnen versturen, maakt HUGO BOSS gebruik van gespecialiseerde dienstverleners, in binnen- en buitenland, aan wie zij de benodigde persoonsgegevens verstrekt. Deze dienstverleners maken uitsluitend namens HUGO BOSS gebruik van uw persoonsgegevens, en zulks uitsluitend in overeenstemming met haar aanwijzingen. HUGO BOSS zal er zorg voor dragen dat zij het bepaalde in deze privacyverklaring naleven en de nodige veiligheidsmaatregelen treffen.

K. Cookies

Zowel HUGO BOSS als HB IM maken op de website en in de Online Store gebruik van zogeheten cookies. Dit zijn kleine tekstbestanden die op het tijdelijke geheugen van uw browser worden opgeslagen (cache/buffer). De in de cookies opgeslagen informatie kan worden gebruikt om uw virtuele winkelwagen te beheren en taalinstellingen die u voor de website hebt geselecteerd te bewaren. L. Gebruik van online analysehulpmiddelen

Op deze website en de Online Store wordt gebruik gemaakt van Google Analytics, een online analysedienst die wordt aangeboden door Google Inc. in de VS (“Google”), alsmede de online analysehulpmiddelen van Webtrekk GmbH in Duitsland (“Webtrekk”). Google Analytics en Webtrekk maken gebruik van zogeheten cookies, kleine tekstbestanden die op uw computer worden opgeslagen en waarmee uw gebruik van de website kan worden geanalyseerd. De verzamelde informatie over uw gebruik van deze website (waaronder uw IP-adres) worden naar een Google-server in de VS of naar een Webtrekk-server in Duitsland verzonden en aldaar opgeslagen. N.B.: HUGO BOSS en HB IM gebruiken de Google Analytics-extensie “_anonymizeIp()”, zodat uw IP-adres wordt ingekort om elke mogelijkheid uit te sluiten dat uw persoonlijke identiteit rechtstreeks kan worden vastgesteld. Webtrekk zal bij het opslaan eveneens uw IP-adres inkorten.

U kunt uw goedkeuring voor het in de toekomst verzamelen en gebruiken van deze informatie door Google te allen tijde intrekken; indien u dit wenst, dient u de Opt-out browser Add-on. Deze optie is bij Google beschikbaar.

M. “Vind ik leuk”-knop van Facebook

HUGO BOSS en HB IM hebben een zogeheten plug-in voor sociale netwerken op de website en de Online Store geplaatst. Deze plug-in is afkomstig van en wordt geëxploiteerd door Facebook Inc., 1601 S. California Avenue, Palo Alto, CA 94304, Verenigde Staten (“Facebook”).

Indien u een webpagina met een dergelijke plug-in bezoekt, maakt uw browser een rechtstreekse verbinding met de servers van Facebook. In dat geval wordt de inhoud van de plug-in rechtstreeks van Facebook naar uw browser verzonden en worden deze gegevens vervolgens aan de webpagina gekoppeld. N. Recht op het verkrijgen en corrigeren van informatie

U hebt het recht kosteloos informatie te verkrijgen over welke persoonsgegevens van u zijn opgeslagen. Daarnaast kunt u uw toestemming intrekken voor het opstellen van een geanonimiseerd gebruiksprofiel ten behoeve van reclame, marktonderzoek of het optimaliseren van onze website. U kunt uw toestemming voor het in de toekomst verzamelen, verwerken en gebruiken van gegevens te allen tijde intrekken.

D. Your HUGO BOSS Customer Account

At the Website, you may set up a personal customer account (my account) for the Online Store (hereinafter referred to as the "Customer Account"). You can save your personal data in your Customer Account and thus make shopping at the Online Store more convenient. Additionally, HUGO BOSS offers you certain convenience features such as the option of viewing your order history and creating a personal wish list in which you can note items to be ordered later.

Your Customer Account will be operated by HUGO BOSS. E. Use of the Online Store

The Online Store integrated into the Website is operated by HB IM. HB IM is your sole contractual partner for any purchases that you make in the Online Store.

In order to make shopping in the Online Store as convenient and easy as possible, the Online Store is directly linked into the Website. With your Customer Account, you can access the data that you have saved in the past without registering again and thus shop more conveniently in the Online Store. HUGO BOSS will make the information which is necessary for processing your order available to HB IM automatically in accordance with the following provisions:

I. Orders Placed From a HUGO BOSS Customer Account

The information saved in your Customer Account is stored in the central customer database of HUGO BOSS and will only be supplied to HB IM on a case-by-case basis and only as required for the purpose of processing your order. When placing an order, you will be requested to enter certain information in the relevant order form “1. Address & Shipping”. Where the needed information has been saved in your Customer Account, it will be entered into the order form automatically. The data will not be transferred to HB IM until you have clicked on the button “continue” in the order form “1. Address & Shipping”.

HB IM will only use your data for the purpose of processing your orders and in connection with the performance of the purchase agreements you conclude with it in the Online Store. Furthermore, HB IM not collect, process or use your personal data for any other purpose without your prior consent.

II. Direct Orders

Naturally, you can also place an order in the Online Store without using an existing Customer Account. In this case, simply enter the information required to process your order in the order form “1. Address & Shipping” and then click on the button “continue” to send the data to HB IM directly. III. Transfer of Order Information

If you have used an existing Customer Account when placing your order in the Online Store, you have, by clicking on the “continue” button in the order form “1. Address & Shipping”, consented to having HB IM transfer certain information related to your order (the item purchased, its price and the time of your purchase) to HUGO BOSS so that your order history (which can be viewed in your Customer Account) can be kept up to date.

You may at any time revoke your consent with future effect without providing any reasons for your decision.

F. My Account

At the Website, you can also create a personal My Account with which you will be able to use a wide range of services and enjoy numerous advantages such as invitations to store events or live broadcasts of fashion shows. Your personal My Account will be operated by HUGO BOSS.

All you need to supply to create your own personal My Account are your first name, surname, address, country, your e-mail address and a password of your choice. The e-mail address you supply will also serve as your User ID when logging into your My Account. Once you have successfully registered, you will automatically receive a confirmation by e-mail.

HB IM will make the personal data that you supplied when placing your order available to logistic providers, both domestic and abroad. HUGO BOSS sends newsletters, at regular intervals, to those interested parties who have subscribed to receive them.
